Defined terms used in these Clover App Market Developer Program Policies (“Polices”) have the same meaning as in the Clover App Market Developer Terms. The Clover App Market Developer Terms and the Policies (together, the “Developer Agreement”) apply to you and your App. If you have any questions about whether you or your App complies with these Policies, you may contact us at appmarket@clover.com.
Prohibited App Type Policies:
- Prohibited App Type Policies: Your App may not facilitate or commit a crime, or other unlawful or illegal act, or facilitate illegal gambling of any kind.
- Financial Services: Your App may not facilitate or provide any financial or money services businesses, such as, currency dealer or exchanger, check casher, issuer/seller or redeemer of traveler’s checks or money orders, money transmitter, provider of lending products or the like, including the creation or sale of a convertible virtual currency. Notwithstanding the foregoing, your App may facilitate or provide prepaid cards, payroll cards, mobile wallets and similar form factors, products or tender types.
Data Policies:
- If your App: (1) collects or discloses any form of user or Device data, (2) captures images, pictures or voice, (3) uses location-based APIs or (4) performs any form of user data, content or information processing, maintenance, uploading, synching or transmission, then you and your App must comply with all applicable privacy and data collection laws and regulations (including, but not limited to, any notice or consent requirements) as well as any Clover requirements related to such aspects.
- Your App may only collect the minimum amount of user data reasonably required to operate your App.
- Your App may not perform any functions or link to any content or use any robot, spider, site search or other retrieval App or device to scrape, retrieve or index services provided by Clover, its affiliates or its licensors.
- Your App may not: (1) collect, disseminate or use information about users for any unauthorized purpose or (2) collect information (such as the user’s location or behavior) without the user’s knowledge (spyware).
- Your App must not disable, override or otherwise interfere with any Clover implemented system alerts, warnings, display screens, consent screens and the like, including but not limited to, those that are intended to notify the user that the user’s location data or other personal data will be collected, transmitted, maintained, processed or used, or are intended to obtain consent for such use. If a user’s consent is denied or withdrawn, then your App may not collect, transmit, maintain, process or use the user’s location data or other personal data or perform any actions for which the user’s consent has been denied or withdrawn.
- You must not sell any user data or any data you obtain from your users’ data.
- You must delete user data or any data derived from user data if (i) at any time a user requests that you cease using such data or (ii) a user no longer consents to your use of such data, and in either case, so long as such deletion may be and is performed in accordance with applicable law and you’ve provided the user of your App with a reasonable period of time to obtain their data from your App prior to such deletion.
Functionality Policies:
- Your App may not itself install or launch other executable code by any means, including, through the use of a plug-in architecture, calling other frameworks, other APIs or otherwise.
- Your App may not provide, unlock or enable additional features or functionality through any distribution mechanisms other than the App Market. Your App may not cause users to unknowingly download or install Apps from sources outside of the App Market.
- Use of a Clover API that allows your App to gain access to certain sensitive data elements may be subject to additional terms and conditions.
- Your App may not contain malicious scripts or functionality that enables password phishing scams.
Developer Account Policies:
- You must take reasonable steps to protect your Developer Account against any unauthorized access and immediately notify Clover of any unauthorized use.
- You must log onto your Developer Account at least once every six (6) months.
- You are responsible for maintaining the confidentiality of any Developer Account credentials that may be issued to you by Clover or that you choose yourself.
- You are solely responsible for all Apps that are developed under your Developer Account.
- We may limit the number of Developer Accounts issued to you.
Content Policies:
Our content policies listed below apply to any content that your App displays, accesses or links to, or any user-generated content to which your App hosts or links.
- Intellectual Property: Your App may not infringe on the Intellectual Property Rights of others or encourage or induce infringement of the Intellectual Property Rights of others.
- Viruses, Worms, Malware, Etc.: Your App may not transmit viruses, worms, defects, Trojan horses, malware or any other items that may introduce security vulnerabilities to or harm Devices, Apps, or personal data. Your App may not contain content that harms, interferes with the operation of, or accesses in an unauthorized manner, networks, servers, or other infrastructure.
- Open Source Software: If your App contains any Open Source Software, you must comply with all applicable Open Source Software licensing terms. You may not use any Open Source Software in the development of your App in such a way that would cause Clover APIs or any other Clover software to be subject to the any Open Source Software licensing terms or obligations. “Open Source Software” means any software that contains, or is derived (in whole or in part) from, any software that is distributed as free software, open source software (e.g., Linux) or similar licensing or distribution models (which includes without limitation, software distributed under the GNU General Public License or GNU Lesser/Library GPL).
- Personal and Confidential Information: Your App may not facilitate or commit the unauthorized publishing or disclosure of consumers’ or Merchants’ private and confidential information, such as credit card numbers, Social Security numbers, tax payer identification numbers, driver’s and other license numbers, or any other information that is not publicly accessible. Your App may not store any Social Security numbers or tax payer identification numbers on any of Clover’s databases or systems without Clover’s prior written consent.
- Deceptive Behavior: Your App may not contain content that implies that your App is authorized by or produced by someone other than you if that is not the case. Your App must not simulate functionality or warnings from Clover’s operating system or other Clover Apps. Your App must not divert users or provide links to any other website that simulates or purports to be another App or service. Your App must not have names or icons that appear confusingly similar to existing products or to any Clover Apps supplied with the Device.
- Obscene or Offensive Material: Your App may not contain any obscene, pornographic, offensive or defamatory content of any kind that in Clover’s reasonable judgment may be found objectionable by users of the Marketplace. Clover has a zero-tolerance policy against child pornography. If we become aware of content with child pornography, we will report it to the appropriate authorities and delete the Developer Account of those involved with the distribution.
- Hate Speech: Your App may not contain any content that promotes hostility toward groups of people based on their race or ethnic origin, religion, disability, gender, age, veteran status, or sexual orientation/gender identity.
App Support and Usage:
- You must include a “quick reference guide” with your App and ensure that your contact information will be displayed in each App detail page on the App Market and made available to Merchants for customer support purposes.
- You must provide required App use information to users, and accurately disclose the security permissions necessary for the App to function on their Devices.
Network Usage Policy:
Your App may not impose an unreasonable or disproportionately large load on Clover’s or users’ of the App Market infrastructure, network capability or bandwidth.
Spam and Placement in the App Market Policies:
- Your App descriptions should not be misleading or overuse keywords in an attempt to manipulate ranking or relevancy in the App Market’s search results.
- You may not attempt to change the placement of your App in the App Market by rating your App multiple times, or by offering incentives to users to rate your App with higher or lower ratings.
- You may not distribute an App whose primary functionality is to: (1) drive affiliate traffic to a website or (2) provide a web view of a website not owned or administered by you (unless you have permission from the website owner/administrator to do so).
- You may not send SMS, email, or other messages on behalf of a user without providing the user with the ability to confirm content and intended recipient.
App Purchase Polices:
- App purchases: If you are charging a fee to Acquire your App in the App Market, you must do so using the App Market’s payment system.
- In-App purchases: If you offer additional content, services, goods or functionality within your App for a fee, you must use the App Market’s payment system as the method of payment for such additional content, services or functionality.
Advertisement Policy:
You must not include any advertising or promotions within any App. Clover may place advertising in the App Market and in conjunction with Apps in the App Market, including your Apps.
App Distribution Policies:
- Clover reserves the right to review Apps submitted for distribution in the App Market.
- Clover may, in its sole discretion: (1) determine that your App does not meet all or some terms of the Developer Agreement then in effect; or (2) reject your request to distribute an App in the App Market for any reason, even if your App meets all of the terms of the Developer Agreement.
Policy Enforcement
Enforcement of these Policies is at our sole discretion. We will notify you if your App is removed from the App Market due to a failure to comply with these Policies. If you have any questions regarding a removal or a rating/comment from a user, you may contact us at appmarket@clover.com. Serious or repeated violations of these Policies will result in the termination of your Developer Account and your Developer Agreement.
Changes to Clover Developer Program Policies
We reserve the right to make changes to these Policies at any time by publishing a revised version of these Policies in the App Market. The revised version will take effect from the time at which it is first published. You will be subject to the Polices that are in effect at the time that you use the App Market to distribute your App. Your continued use of the Clover API or the App Market to distribute your App indicates your acceptance of any updates and changes. You are advised to check the Policies from time to time for any updates or changes that may affect you and/or your App. We last modified these Polices on the date stated at the beginning of these Polices.
